  1. Customers must provide truthful and up-to-date information when creating an account.

  1. The Official-GO-HALAL App may require confirmation of an email address and telephone number for verification.

  1. Guest orders may be offered. Certain functions, such as reviews, bonus points or referral programs, may require a verified customer account.

  1. Users may not use another person's account or provide false information.

  1. In cases of misuse, suspected fraud or serious violations, access to the platform may be temporarily restricted or suspended. The customer's statutory rights remain unaffected.

§ 4 Services Provided by the Platform

  1. The Official-GO-HALAL App provides a digital intermediary platform through which customers can select and order food from participating restaurants.

  1. Restaurants generally determine their own food items, product information and prices.

  1. The platform may provide additional information about restaurants, products, delivery times, ratings, halal checks and availability.

  1. The platform may offer the following features, among others:

  • Map and location functions

  • Order and delivery tracking

  • Restaurant pickup

  • Reviews and ratings

  • Bonus points and discount codes

  • Referral program

  • Product boycott information

  1. The availability of individual functions may depend on technical, geographical or operational conditions.

§ 5 Offers and Formation of Contract

  1. The display of food items and delivery services on the platform generally does not constitute a legally binding offer to enter into a contract.

  1. Customers can select products, add them to their basket and review their order details before submitting the order.

  1. By clicking a clearly marked button, such as “Place order with obligation to pay,” the customer submits a legally binding offer.

  1. Receipt of an order may be confirmed electronically. A confirmation of receipt does not, by itself, constitute acceptance of the order.

  1. The contract for the food generally comes into existence between the customer and the respective restaurant once the restaurant accepts the order.

  1. The applicable contractual partner and delivery service must be clearly displayed to the customer during the ordering process.

  1. A restaurant may reject orders, for example, because products are unavailable, the delivery address is outside the service area or for operational reasons.

§ 6 Prices, Minimum Order Value and Fees

  1. Food prices are generally determined by the respective restaurant.

  1. Before the customer submits a binding order, the total price and all applicable fees will be displayed.

  1. A distance-based delivery fee may be charged for deliveries. The fee is calculated automatically based on the relevant delivery distance and is displayed before the order is completed.

  1. A uniform minimum order value applies. The amount will be displayed to the customer before the order is completed.

  1. S.A.B-AL may receive a commission from the restaurant for intermediary services. This commission will not be charged separately to the customer unless it is expressly displayed as a separate fee.

  1. Applicable taxes and other price components will be displayed in accordance with legal requirements.

§ 7 Payment Methods

  1. Depending on availability, the following payment methods may be offered:

  • Credit or debit card

  • PayPal

  • Apple Pay or Google Pay

  • Cash on delivery

  • Cash payment upon pickup

  1. Payment by invoice, Klarna or comparable financing or debt-based payment models will generally not be offered unless expressly made available during the ordering process.

  1. In the case of cash payment, the customer must pay the full amount due upon delivery or pickup.

  1. Online payments are also subject to the terms and conditions of the relevant payment service provider.

  1. Payment processing must be structured so that the distribution of funds between the restaurant, driver and S.A.B-AL corresponds to the applicable contractual arrangements.

§ 8 Delivery and Delivery Times

  1. Delivery may be carried out by a self-employed driver or, where offered, by the respective restaurant.

  1. When a driver carries out the delivery, the order is generally handed over by the restaurant to the driver and transported to the delivery address provided by the customer.

  1. The delivery time displayed during the ordering process is an estimate and may be affected by preparation time, traffic, weather, workload or other circumstances.

  1. The restaurant's estimated preparation time and the estimated delivery time may be displayed together.

  1. Orders may be tracked through the platform where this function is technically available.

  1. In the case of restaurant delivery, the order may continue to be tracked through the platform, provided that the restaurant supplies the required information.

§ 9 No Driver Available

  1. If no driver is available after an order has been accepted, the customer will be informed of the situation as soon as reasonably possible.

  1. Where technically available, the customer may choose whether to wait for a driver or cancel the order.

  1. If the restaurant offers its own delivery service and is willing to provide it, the delivery may be carried out by the restaurant.

  1. The available options will be displayed to the customer through the platform.

  1. If the order cannot be completed, the affected payments will be reversed in accordance with applicable law and the specific contractual conditions.

§ 10 Pickup

  1. Customers may select pickup at participating restaurants.

  1. The restaurant will provide information regarding the estimated time when the order will be ready for pickup.

  1. To prevent confusion or incorrect handovers, an individual app code will be used for pickup.

  1. The customer may be required to present the app code when collecting the order.

  1. The restaurant may reasonably verify the customer's identity or authorization to collect the order.

§ 11 Cancellation by the Customer

  1. Customers may generally cancel an order free of charge through the app or website as long as the restaurant has not yet started preparing the order.

  1. Once preparation has started, free cancellation cannot be guaranteed.

  1. In such cases, an assessment will be made of the services already provided and the costs incurred.

  1. Any refund will be handled in accordance with statutory consumer rights and the circumstances of the individual case.

  1. The cancellation function should be displayed to the customer in the order status.

§ 12 Complaints and Refunds

  1. Complaints may be submitted through the app, website or available support channels.

  1. Customers should describe the issue as soon as reasonably possible and in a comprehensible manner. Depending on the case, photographs or additional information may be requested.

  1. Complaints may concern, among other things:

  • Missing products

  • Incorrect orders

  • Damaged packaging

  • Significant delivery delays

  • Failure to deliver

  • Other justified complaints

  1. The restaurant is generally responsible for the preparation, quality, completeness and packaging of the food.

  1. In the case of problems relating to intermediary or delivery services, the customer may contact The Official-GO-HALAL App support team.

  1. Following an individual review, a partial or full refund may be granted where legally and factually justified.

  1. The customer's statutory rights are not excluded by the complaints procedure.

§ 13 Failure to Accept a Delivery

  1. Customers must be reachable at the telephone number provided and accept the order at the agreed delivery location.

  1. If the customer cannot be reached or delivery cannot be completed, attempts will be made to contact the customer using the available contact methods.

  1. Any costs arising from an unsuccessful delivery will be reviewed in accordance with applicable law and the circumstances of the individual case.

  1. A refund may be reduced by costs incurred, provided that such reduction is legally permissible.

  1. For food safety reasons, food cannot automatically be delivered again. Further handling of the food must comply with applicable food safety requirements.

§ 14 Halal Concept and Halal Verification

  1. The Official-GO-HALAL App aims to provide customers with access to halal-compliant food and products only.

  1. For this purpose, S.A.B-AL carries out its own verification procedures. These may include:

  • The origin and sources of ingredients

  • The origin of meat

  • Suppliers and supporting documentation

  • The composition and products used

  • Preparation and processing procedures

  • The handling of halal and non-halal products

  • Documents and other evidence provided by the restaurant

  1. Restaurants may be required to provide accurate and complete information about their products and preparation processes.

  1. Verification may take place before a restaurant is listed and as part of subsequent inspections.

  1. The Official-GO-HALAL App follows a careful verification approach. However, it cannot guarantee that all ingredients, supply chains and preparation processes can be checked completely and without error at all times.

  1. If significant inconsistencies or violations are identified or reasonably suspected, a restaurant may be removed from the platform immediately.

  1. Relevant violations may be communicated to affected customers and, where appropriate and legally permissible, to the public.

  1. Halal verification does not replace the restaurant's responsibility for the accuracy of its information or the actual preparation of its food.

§ 15 Reviews and Ratings

  1. Reviews may generally be submitted only by registered and verified customers who have actually placed an order.

  1. Reviews must be factual, truthful and based on the user's own experience.

  1. The following are prohibited in particular:

  • Insults and threats

  • False statements of fact

  • Manipulated reviews

  • Advertising and spam

  • Content that infringes third-party rights

  1. The Official-GO-HALAL App may remove unlawful or rule-violating content following a review.

  1. The criteria used for ratings and rankings should be presented transparently to users.

§ 16 Discount Codes, Bonus Points and Referral Program

  1. The Official-GO-HALAL App may offer discount codes, bonus points and a referral program.

  1. The applicable conditions, validity periods, redemption requirements and possible restrictions will be displayed when the benefits are issued or in the customer's account.

  1. Bonus points may be earned through orders and successful referrals.

  1. Bonus points and discount codes cannot generally be exchanged for cash unless expressly stated otherwise.

  1. Misuse, including the creation of fake accounts or manipulation of referrals, may result in the suspension or cancellation of the relevant benefits.

  1. Statutory rights already acquired by the customer remain unaffected.

§ 17 Tips

  1. Customers may voluntarily provide a tip to the delivery person where this function is offered.

  1. The tip will be forwarded in full to the respective driver unless otherwise transparently stated during the ordering process.

  1. Processing will take place through the available payment method.

  1. The treatment of tips in cases of cancellation and refunds will be transparently regulated during the ordering process.

  1. The customer's statutory rights in the event of services not being provided or being provided improperly remain unaffected.

§ 20 Liability

  1. S.A.B-AL shall be liable without limitation in cases of intent and gross negligence, as well as for damages arising from injury to life, body or health.

  1. Liability under mandatory statutory provisions, including product liability law, remains unaffected.

  1. The respective restaurant is generally responsible for the preparation, quality, ingredients and packaging of the food, to the extent legally permissible and provided that the specific contract establishes this responsibility.

  1. S.A.B-AL shall be liable for its own breaches of duty in accordance with applicable law.

  1. Any limitation of liability must not result in the exclusion of mandatory statutory rights of the customer.

§ 21 Data Protection

  1. Personal data will be processed in accordance with applicable data protection laws.

  1. Further details are provided in the separate Privacy Policy of The Official-GO-HALAL App.

  1. The Privacy Policy must include information about the processing of contact details, location data, order information, payment data and verification data, among other things.

§ 22 Amendments to the Terms

  1. Amendments to these Terms will be communicated to customers in an appropriate manner where notification is legally required.

  1. Amendments will not be used to restrict mandatory statutory consumer rights.

  1. For orders that have already been completed, the terms applicable at the time the relevant contract was concluded will generally apply, unless otherwise provided by law.

§ 23 Consumer Rights and Dispute Resolution

  1. Statutory consumer rights remain unaffected.

  1. Whether and to what extent a statutory right of withdrawal exists depends on the specific service. Statutory exceptions may apply to individually prepared or rapidly perishable food. The applicable withdrawal information must be separately reviewed and correctly provided.

  1. Information concerning consumer dispute resolution will be provided in the legal notice or at another legally required location.

  1. All applicable statutory information requirements, particularly those relating to the conclusion of paid orders, must be complied with.

  1. The statutory provisions shall replace any invalid provision.

  1. These Terms shall enter into force upon publication or on the stated effective date.
